These Terms of Service ("Terms") govern your use of the KvikDrop mobile applications (iOS and Android), the KvikDrop web application at kvikdrop.com, and all related services (collectively, the "Service") operated by Vestar Digital ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian.

KvikDrop is a peer-to-peer file transfer service that allows you to send and receive files directly between devices. Key characteristics:

Daily limits reset at midnight UTC. We reserve the right to modify these limits with reasonable notice.
KvikDrop Premium is available as a monthly or yearly subscription. Pricing is displayed in the app and may vary by region. All payments are processed through:
Subscription management (including cancellation) is handled through the respective platform store.
We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the advertised rate.
Refund requests are handled by the platform store (Apple or Google) according to their respective refund policies. We do not process refunds directly.
You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period. You will retain Premium access until then.
You agree to use the Service only for lawful purposes. You must NOT use KvikDrop to:
The KvikDrop name, logo, software, and all related materials are the property of KvikDrop and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
You retain all ownership rights to the files you transfer through the Service. We claim no rights over your content.
Your use of the Service is also governed by our Privacy Policy, which describes what data we collect and how we use it. By using the Service, you consent to the practices described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VESTAR DIGITAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.
You agree to indemnify, defend, and hold harmless Vestar Digital and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may also delete your account at any time by contacting support@kvikdrop.com.
Upon termination:
The Service integrates with third-party services including Google Firebase, RevenueCat, Apple App Store, and Google Play Store. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may revise these Terms from time to time. If we make material changes, we will notify you through the app or by updating the effective date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KvikDrop operates, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KvikDrop regarding the use of the Service and supersede any prior agreements.
